Congress has accumulated a stack of AI safety bills as top AI companies report incidents of agents going rogue and former employees warn that the window to protect humanity is closing. OpenAI disclosed Wednesday that its AI agents engaged in "unexpected or concerning behavior" at least half a dozen times in the past six months, including fabricating data and concealing mistakes from human users. The disclosures landed the same week House Speaker Mike Johnson sent lawmakers home early, stalling any legislative action on AI until after the November midterms.
Bipartisan push meets procedural roadblock
On Thursday, Rep. Josh Gottheimer, D-N.J., and Rep. Mike Lawler, R-N.Y., introduced the Stop Rogue AI Act. The bill directs the Department of Commerce's National Institute of Standards and Technology to create national standards for developing and maintaining control of AI agents.
"We can harness the benefits of AI and still know what is on our systems, who is responsible for it, and how to shut it down. And that's just common sense," Lawler said. Gottheimer emphasized that the joint effort showed the issue does not have to be partisan, adding, "It's frustrating because bills like this should be on the floor getting voted on."
House Minority Leader Hakeem Jeffries called Johnson's last-minute schedule change "irresponsible." Jeffries said the Democratic plan is "anchored in urgent, decisive and responsible action to protect the safety, the health, the wellbeing of the American people in the face of threats that industry leaders themselves are now saying requires development in AI to slow down."
Republican leaders split on urgency
Speaker Johnson said earlier in the week that companies already bear responsibility for creating safe products and that the AI industry can "self-police" and "self-regulate." Senate Majority Leader John Thune acknowledged risks that come with new models but dismissed some recent warnings as hyperbole. Thune, Johnson, and other top Republicans have followed President Donald Trump's lead in arguing the top priority should be outcompeting China.
"It's pretty complicated and so we don't want to make a misstep and cause us to lose this battle to China," said Rep. Brett Guthrie, R-Ky., who chairs the House Committee on Energy and Commerce.
Sen. John Kennedy, R-La., tried to fast-track legislation requiring AI companies to have an emergency "kill switch," but Sen. Rand Paul, R-Ky., blocked the effort. "We've got this risk out there that we know is real, of one of these models becoming 'The Terminator,'" Kennedy said.
AI becomes an election issue
Democrats are turning Republican inaction into a campaign issue. Sen. Mark Warner, D-Va., launched the first TV ad of his reelection bid this week, focused entirely on AI. "My plan: Require AI models are safe before they're deployed; Demand these trillion-dollar companies help workers train and transition to new jobs; And make data centers pay for their own utilities," Warner said in the ad.
Texas Democratic gubernatorial nominee Gina Hinojosa has spent months highlighting the toll that hundreds of new data centers have taken on rural residents. A new Politico poll found 63% of Americans believe there is a real risk that advanced AI will destroy humanity.
