Samuels on September 2, 2026, is the broadest student-facing AI restriction in the country and pairs the freeze with new screen time limits and tightly controlled high school pilots.

"Children need teachers and human connection in order to learn and grow," Mayor Mamdani said. "The tech industry wants us to believe that A.I.-powered early education is not only inevitable, but necessary. We do not see it that way." The administration will spend the next year studying the technology's effects before considering any expansion.

What the moratorium covers

The ban eliminates all software that uses student-facing generative AI for children from 2-K through 8th grade. Companion chatbots are prohibited across all grades. For the youngest students, the policy introduces hard screen time caps: 30 minutes per day for 3rd through 5th graders and 45 minutes for 6th through 8th graders, while students in 2nd grade and below will see restricted one-to-one screen time.

Teachers can continue using AI for instructional planning and operational tasks, provided the tools meet NYC Public Schools safety standards. Exceptions to the student-facing ban cover assistive technology for students with disabilities, multilingual learners, and career readiness programs such as computer science.

Limited high school pilots under strict guardrails

Five AI pilots will reach a maximum of 50,000 high school students in general education classes - roughly 5% of the public school body. Each participating high school can run the pilots in no more than five classrooms, with all use supervised directly by a trained educator using vetted tools. All high school students will also complete two 45-minute AI literacy modules per year. The sessions cover what AI is and is not, along with bias, risk, ethics, and the technology's impact on careers and future skills. Vendors must meet accountability standards for safety, transparency, ethics, learning design, instructional impact, and continuous user feedback. Chancellor Samuels framed the move as a protective measure. "We're putting guardrails in place to protect the human connection, curiosity and creativity that help children grow," he said. "We're standing firmly in our belief that innovation does not mean more technology, and over the next year, we will lead with evidence to make sure technology serves learning - not the other way around."
