POLITICO Shuts Down AI Tools After Labor Arbitration Loss
POLITICO has agreed to shut down both artificial intelligence products that violated its union contract, ending a dispute that produced one of the first major labor rulings on AI in American journalism.
The company will discontinue Capitol AI Report-Builder, which generated policy reports for subscribers without editorial review, and will not restart "Live Summaries," an AI feature that produced error-filled coverage of major political events including the 2024 Democratic National Convention.
An arbitrator ruled in November 2025 that both tools violated the POLITICO and E&E News Guild's collective bargaining agreement. The union had filed grievances in August 2024, claiming POLITICO deployed the tools without the required 60-day notice, good-faith bargaining, or human oversight.
What the Arbitrator Found
The arbitrator stated plainly: "If accuracy and accountability is the baseline, then AI, as used in these instances, cannot yet rival the hallmarks of human output."
POLITICO bypassed contract protections by deploying both tools unilaterally. The union's 2024 contract - among the first in media to include enforceable AI protections - required the company to notify the guild and bargain before deploying new AI that could affect job duties.
Why This Matters for Management
This case signals that union contracts with AI provisions will be enforced. Managers at news organizations and other companies cannot assume they can deploy AI tools without following contractual notice and bargaining requirements, even if those tools promise efficiency gains.
The remedy extends beyond the arbitration win. After the November ruling, union leaders negotiated with POLITICO management repeatedly until the company agreed to shut down both products entirely rather than modify them.
