China's inventors published more than 43,000 generative AI patent families in 2024 and 2025, a total that exceeds the country's cumulative output from the previous decade, according to a July 2026 report from the World Intellectual Property Organization. The surge in filings concentrates IP risk and opportunity for legal teams, signaling where patent thickets, licensing disputes, and enforcement actions are most likely to arise.
China's concentration of GenAI patent filings
The WIPO Technology SPARK Report, "Patent Trends Update in GenAI", places China first globally by volume. Its compound annual growth rate for GenAI patent families reached 64% between 2023 and 2025. Six of the world's ten largest patent applicants in the field are Chinese entities. Tencent Holdings leads with 2,702 patent families, followed by Ping An Insurance Group (2,240) and Baidu (1,902). The Chinese Academy of Sciences holds 1,396 families, making it the top research institution, while State Grid Corporation of China has 1,144 families, 853 of which were published in just the last two years. Other top-25 entrants include China Southern Power Grid, Inspur Group, and Ant Group, spanning energy, cloud infrastructure, and fintech.
US acceleration and global growth rates
The United States saw GenAI patent families jump from roughly 1,185 in 2023 to over 4,380 in 2025, a 92% CAGR that outpaced China's relative growth. Alphabet (Google) remains the largest US-based owner with 1,083 families, while Microsoft (865) and IBM (821) follow. Nvidia entered the top 25 for the first time, with 497 families and 333 published in 2024-2025, as it pushes into AI software and model architectures. Several other countries, including Japan, Germany, Canada, and Switzerland, posted CAGRs above 80%, narrowing the gap with China on a percentage basis even as the absolute volume gap remains wide.
Patents spread beyond traditional tech
WIPO Director General Daren Tang said, "Gen-AI patents are no longer just being filed by tech companies but also by large enterprises in areas like finance, telecommunications, infrastructure and other digital services." This pattern plays out clearly in China's portfolio, which includes internet platforms, insurers, utilities, and telecom operators. Globally, Japanese conglomerate SoftBank holds nearly 3,000 patent families published almost entirely in 2025, making it the single largest GenAI patent holder by portfolio size. Across all countries, more than 56,000 new GenAI patent families were published in 2024 and 2025-exceeding the cumulative output of the 2014-2023 period. GenAI now accounts for 8.7% of all AI-related patent publications.
Why this matters for legal professionals
Patent attorneys and in-house counsel face a rapidly shifting enforcement map. The concentration of GenAI filings in China means that companies competing in AI-driven sectors-fintech, energy, telecommunications, insurance-must assess overlapping claims from major Chinese patent holders, many of which are not traditional technology firms. The US growth rate, while still trailing in volume, signals that litigation and licensing activity will intensify domestically as Nvidia, Google, and others convert R&D into enforceable rights. Legal teams also need to track SoftBank's sudden, massive filing campaign and its potential to trigger cross-border disputes, standard-essential patent claims, or FRAND licensing obligations. A clear-eyed review of both the Chinese patent portfolio and the fast-moving US and Japanese entrants is now a prerequisite for any competitive IP strategy in generative AI.
