The U.S. Federal Trade Commission penalized Cox Media Group and two marketing agencies for misleading advertisers about their ability to use AI to target ads based on conversations near smart devices. Cox Media agreed to pay $880,000, while MindSift and 1010 Digital Works each paid $25,000.

Cox told potential advertisers in 2023 that it used artificial intelligence and voice-processing technology to "identify buyers based on casual conversations in real time," according to the FTC. The company also falsely claimed that consumers had opted in to voice data collection and use.

On its website, Cox marketed the capability with the phrase: "Creepy? Sure. Great for marketing? Definitely," the FTC said.

Cox operates radio and broadcast television stations across multiple states and runs a digital marketing division focused on streaming and online advertising. The company said it had relied on marketing materials from a third-party vendor about the vendor's product, which it has since stopped using.
