Leading artificial intelligence companies now openly warn that their technology could one day threaten humanity. But if executives at OpenAI and Anthropic believe their own dire predictions, a practical legal question emerges: can anyone sue to stop them before disaster strikes? The answer, according to legal experts, is far from straightforward.

Attorneys who spoke with Law360 said the path to preemptive litigation faces enormous hurdles. Standing requirements, speculative damages, and the sheer difficulty of proving an existential threat in court all stand in the way. The discussion comes as AI safety concerns have moved from academic papers to congressional hearings and corporate boardrooms.

The standing problem

To bring a lawsuit, a plaintiff must show concrete, particularized injury - not a generalized fear about the future. Courts have historically rejected claims based on hypothetical harms. "You can't sue because you're afraid something might happen," one litigator told Law360. This principle alone blocks most would-be plaintiffs before they ever reach the merits of an AI risk case.

The challenge intensifies when the alleged harm is global catastrophe. If an AI system were truly capable of causing human extinction, the injury would be universal. But universal harm, paradoxically, makes individual standing harder to establish. No single person can claim a unique injury that distinguishes them from everyone else on the planet.

Who would you sue, and for what?

Identifying the right defendant presents another obstacle. AI development involves multiple actors: model creators, cloud providers, downstream deployers, and corporate partners. Each operates under different legal duties. A lawsuit would need to pinpoint which entity bears responsibility for a risk that has not yet materialized.

Existing tort law offers few clear hooks. Negligence claims require a duty of care and a breach that causes harm. Product liability typically applies after an injury occurs. "The law is reactive by nature," one attorney said. "It's not designed to prevent speculative future harms, no matter how catastrophic." Some legal scholars have proposed novel theories around public nuisance or abnormally dangerous activities, but none have been tested in this context.

Corporate warnings as a double-edged sword

Statements by AI executives about existential risk could, in theory, be used against them. When a company's own CEO tells Congress that Generative AI and LLM systems might pose extinction-level threats, plaintiffs' lawyers take notice. Those public admissions could support arguments about foreseeability - a key element in negligence cases.

Yet those same warnings often come wrapped in calls for regulation, which complicates the legal picture. A company that asks government to impose safety rules can argue it is acting responsibly, not recklessly. Defense counsel would likely frame such statements as evidence of good faith rather than admissions of liability. The tension between sounding alarms and avoiding legal exposure remains unresolved.

Why this matters for legal professionals

For attorneys practicing in technology, tort, or regulatory law, the AI risk question is not academic. Clients are already asking how to manage liability exposure from AI deployment, and courts will eventually face these questions. Understanding the standing and causation barriers now helps lawyers advise both plaintiffs and defendants realistically.
