AI agent for patent agents

Claim Set Consistency Check Agent

A claim set free of formal errors and supported by the description

Claim Set Consistency Check Agent: what goes in, what the agent does and what you get

What it does

Small drafting errors in patent claims lead to office actions, extra fees or weaker protection. When claims are drafted, this agent checks antecedent basis for every term, claim dependencies and numbering, and confirms each claim term is supported in the description. It flags terms without antecedent and dependent claims that refer to later claims. It checks claim counts against fee limits and notes the extra cost when they are exceeded. It lists each problem with a suggested fix. After the patent agent edits, it rechecks the whole set, not just the changed claims, until every check passes. The patent agent decides all claim wording; the agent only suggests. Edge case: a dependent claim refers to a later claim, which is not allowed, so the agent flags it and suggests renumbering.

How it works

Follow the arrows from top to bottom. The orange dashed arrow is the loop: when a check fails, the agent goes back and tries again.

An example run

What happensFor a 24-claim application drafted October 6, the agent found 7 problems: three terms without antecedent basis, claim 18 depending on later claim 21, and one term not supported in the description. It suggested fixes. After edits, the recheck failed on a new antecedent problem in claim 9 created by renaming a term. The agent flagged it, the patent agent fixed it, and the third check passed. The patent agent approved the claims.
