U.S. privacy laws trail far behind AI and surveillance tools, leaving tech companies facing fines too small to change behavior. Experts say consumers never had a real choice, and federal reform looks unlikely.

Privacy Laws Lag Behind AI as Tech Companies Face Minimal Penalties

Tech companies are collecting vast amounts of personal data through artificial intelligence and surveillance tools with little legal consequence, leaving privacy protections decades behind the technology itself.

Recent high-profile incidents expose the gap. Ring, Amazon's doorbell camera company, faced backlash over a Super Bowl ad celebrating the technology's role in tracking a lost dog - a scenario that privacy advocates saw as a preview of AI-powered surveillance networks available to law enforcement and corporations.

The FBI retrieved Nest camera footage from Nancy Guthrie's Tucson home after she was abducted, even though Google's privacy policy states video expires after three hours. The company said the data came from "residual data located in backend systems." The incident raised questions about how long companies actually retain footage and whether users understand what data persists.

Google has denied using Nest video to train AI models but reserves the right to use "inputs, including prompts and feedback" from AI interactions to develop its generative models.

Fines Don't Deter Corporate Behavior

Meta paid $725 million to settle privacy violations. Disney paid $2.75 million, a record under California's privacy law, for not fully honoring user requests to opt out of data sharing. For companies of that size, these amounts function as business costs rather than genuine penalties.

"Fines like this are like affirmations for these big tech firms," said Sree Sreenivasan, CEO of Digi Mentors. "A nine-figure fine sounds enormous until you realize the number looks like a rounding error on a quarterly earnings call," added Paul Armstrong, a tech advisor.

Peter Jackson, a cybersecurity and privacy attorney at Greenberg Glusker, said current law is inadequate. "US privacy law is not sufficiently armed with penalties strong enough to incentivize companies to do better," he said.

The Legal Framework Is Outdated

Federal privacy laws are insufficient. "Right now the laws we have are essentially running a dial-up connection in a 5G world," Armstrong said.

Michel Paradis, who teaches artificial intelligence law at Columbia University, said Americans must reset expectations about privacy. "We're definitely in a stage where we have to start resetting our expectations about what is private. And we also just have to be very cautious," he said.

On paper, Americans have more protections than ever. In practice, the system fails. Privacy disclosures are "technically thorough and practically useless," Jackson said. "Most people don't really understand what any of it means."

AI Chatbots Create New Legal Questions

Chatbots differ fundamentally from search engines. They don't return links - they respond conversationally, creating what Paradis called "the intimacy of the chatbot experience."

That intimacy masks a legal reality: nothing shared with a chatbot receives confidentiality protections. "Legally, there's no reason at all that anything you put into a chatbot should be considered as anything other than the type of information you would give to a bank," Paradis said. Banks can be forced to hand over customer records by court order.

OpenAI faced criticism after employees discovered that Jesse Van Rootselaar, an accused Canadian school shooter, had posted disturbing messages to ChatGPT. The company banned his account but did not alert police.

The situation exposes a legal void. "The ChatGPT situation with the Canadian shooter exposes a no-win scenario nobody has legislated for yet," Armstrong said. "Failing to report means complicity, but reporting means building a surveillance apparatus capable of flagging someone for a thought."

Consumers Accept the Trade-Off

Americans have consistently chosen convenience over privacy. The pattern began with cookies - small text files that websites use to remember login information and preferences. When cookies first appeared, users accepted them without question because rejecting them degraded the online experience.

Gmail promised unlimited messages with no deletion required. Users quickly realized Google was scanning emails to sell targeted advertising. The same pattern repeats with doorbell cameras, streaming services, and AI tools.

"Users or consumers have been very happily trading free stuff for their data," said Arash Vakil, a business professor at CUNY. "We've kind of become accustomed to the convenience this technology offers. But you have to remember: if the product is free, then you are the product."

Others argue consumers never had genuine choice. "People were never given a genuine choice to either accept these terms or don't use the product," Armstrong said. "Opting out increasingly means opting out of modern life."

State Action May Move Faster Than Federal

Don't expect Congress to act quickly. "Certainly at the federal level, I think that's going to be very unlikely," Paradis said of stricter AI legislation. The Trump administration has taken a libertarian approach, pushing agencies to preempt state AI regulations.

Most real action will occur at the state level over the next few years, Paradis said. "We are sort of in a digital Wild West," Jackson said. "Our legal system in its current state is not built to fight such battles."

Paradis remains cautiously optimistic that society will adapt, as it has with past disruptive technologies like cameras and radio. "This is not the first major technology that's created huge disruptions to our sense of privacy. We've gotten smarter about it. And I think the same will happen now," he said.
