Underwriters saw your generative AI rollout. Now they want proof you can control it.
As insureds adopt AI, exposures are showing up across multiple lines-cyber, employment practices liability, product liability, and errors and omissions. Cyber underwriters are zeroing in on intellectual property (IP) infringement, data integrity and poisoning, prompt injection, and the strength of contracts with AI vendors.
What cyber underwriters are asking for
- AI use inventory: A clear list of internal and third-party AI systems, data flows, and business processes they touch.
- Risk register by use case: Mapped threats such as IP infringement, model errors, prompt injection, data leakage, privacy exposure, and integrity/poisoning.
- Incident response updates: Playbooks that account for AI-specific events (model rollback, kill-switches, data revocation, legal holds, and vendor escalation paths).
- Contractual protections with AI vendors: Indemnities for IP/privacy claims, audit rights, data ownership and usage limits, security obligations, breach notification, and liability caps with carve-outs.
- Data governance: Approved training data sources, logging/traceability, retention/deletion rules, human-in-the-loop controls, and protections against shadow AI.
- Access and secrets management: Role-based access, segregation of environments, and controls to prevent sensitive data from training or prompts.
Carriers are still in early days on AI governance diligence, but they expect a "good accounting" of how AI is used, the risks tied to those uses, and what changed in your controls to address them.
Regulatory and legal pressure is rising
States are moving first. California, Utah, Colorado, and Texas have enacted AI-related laws, with more likely in the pipeline. On top of that, there are hundreds of active legal cases tied to data bias, IP and trademark disputes, privacy, discrimination, and broader regulatory risk.
This mix raises discovery and compliance costs-and shifts how carriers think about frequency and severity. Documented governance and clear vendor contracts shorten the path from "we have exposure" to "we can price it."
Expect coverage questions-and tighter terms

Limit modeling: make AI risk financial
Set risk appetite first: what will you retain versus transfer? Then quantify. Build plausible AI loss scenarios and scale them to company size, operations, and data footprint. That analysis informs limits, deductibles, and where to buy broader coverage versus accept retention.
- IP infringement: Generated content triggers a claim and defense costs.
- Data integrity/poisoning: Corrupted data drives bad decisions and remediation expense.
- Prompt injection/data leakage: Sensitive data exfiltrated via an LLM interface.

What "good" looks like to an underwriter
- Written AI policy and governance mapped to a recognized framework such as the NIST AI Risk Management Framework.
- Named owners for each AI use case, with sign-offs from legal, security, privacy, and business.
- Red-teaming and testing for prompt injection and misuse (see OWASP Top 10 for LLM apps).
- Vendor tiering, SOC2/ISO evidence collection, and contract clauses that actually shift risk.
- Updated IR playbooks, table-top exercises including AI scenarios, and logging that supports forensics.
- Benchmarking against peers and documented rationale for purchased limits.
For brokers and carrier teams
- Push clients to maintain a current AI asset inventory and risk register.
- Pre-collect vendor contracts, indemnities, and security exhibits before marketing the risk.
- Run limit modeling with scenario ranges (best/expected/worst) to justify limits and structure.
- Clarify how AI exposures map across cyber, E&O, EPL, and product liability to avoid gaps.
- Track state-by-state obligations and update underwriting guidelines as new laws land.
