Government-mandated AI surveillance threatens liberty

The recent clash between a federal security agency and a leading AI lab forced a blunt question into the open: Are we comfortable with a future where every prompt is logged and every move is profiled? People aren't. They're right to worry - AI supercharges surveillance by pulling in more data, processing it faster, and drawing tighter conclusions about each of us.

Here's the twist. While many push back hard against government use of AI for mass monitoring, some of those same voices support laws that force AI companies to monitor users and report "concerning" behavior. That's surveillance of AI - and it raises the same constitutional alarms.

Surveillance of AI is still state surveillance

Several states have considered or adopted rules that require AI platforms to flag and refer users based on their prompts (for example, content related to self-harm), and to notify third parties such as crisis services or even parents. There is no way to comply without watching users more closely, logging more data, and building pipelines to share it.

Good intentions don't change the core issue. When the state deputizes private companies to monitor speech and report it, that's government action carrying First and Fourth Amendment risk. The pain is real - but mandates aren't the fix

Families have lost loved ones. It's human to want a system that sees the warning signs and steps in. We should build tools that help - and many already exist.

Parents can choose AI platforms with opt-in oversight, usage transparency, and pattern alerts. Teens who need privacy for tough questions can find that as well. That voluntary, layered market protects both safety and dignity. Swapping it for state-scripted monitoring flips the default from "family choice" to "government control."

A better path for public officials

We can protect vulnerable users without normalizing surveillance. Here's a practical framework you can use in drafting, oversight, and procurement.

  • Opt-in, family-controlled tools: Encourage platforms to offer parental dashboards, crisis-mode features, and shared context - enabled by families, not the state.
  • Transparency by design: Clear notices on what is logged, how long it's kept, and what triggers any intervention. No dark patterns. No hidden reporting.
  • Data minimization: Process on-device where possible, delete by default, and prohibit building long-term behavioral profiles from safety checks.
  • Strict legal process: Bar generalized monitoring. If disclosure is compelled, require a warrant and narrow scope consistent with Carpenter.
  • Narrow emergency exceptions: Define immediate, life-threatening criteria with independent review, short retention, and after-action transparency.
  • Independent audits: Require third-party testing of false positives/negatives, demographic impacts, and chilling effects on speech.
  • Support, not mandates: Provide grants and safe harbors for voluntary crisis-support features, research, and public-health integrations.
  • Procurement leverage: In government contracts, ban generalized prompt logging, require privacy-by-default, and publish data-handling terms.
  • Guardrails against mission creep: Clear scope limits, access controls, immutable audit logs, and sunset clauses with evidence-based renewal.

Policy checklist before you draft or vote

  • What exact harm are we addressing, and is there a less intrusive alternative that families can choose voluntarily?
  • Where does user data flow, who sees it, and for how long? Map and publish this.
  • Does the bill narrowly target imminent risk, or does it normalize continuous monitoring?
  • What's the redress path for users wrongly flagged or notified on?
  • How will we measure unintended impacts on speech, inquiry, and trust - and report those publicly?
  • Is there independent oversight, a warrant standard, and a sunset with mandatory review?

Bottom line

We don't have to choose between safety and civil liberties. We can empower families, fund voluntary safeguards, and keep government out of people's private prompts unless due process demands otherwise. The same energy used to oppose mass surveillance should be applied to any law that quietly rebuilds it through private platforms.
