- Preventative: You build with safety up front because you could be held liable for harms. Think: safe defaults, testing before release, and risk controls baked into the core product decisions.
- Responsive: If harm occurs, there's a clear path for users and businesses to seek accountability. Your documentation, logs, and warnings will matter in court.
What this means for your roadmap
- Make safety a feature, not a setting: Default to safer modes for high-risk topics (self-harm, medical, legal, financial). Provide a friction path to escalate to a human where appropriate.
- Build a "failure to warn" defense into UX: Clear, context-aware warnings before risky use. Prominent labels for limitations, confidence, and known failure modes, not buried in T&Cs.
- Instrument everything: Keep auditable logs of prompts, model versions, safety filters, and overrides. You'll need evidence of due care, not marketing claims.

- Plan for minors by default: Age-aware flows, stronger guardrails, and content filters. Safer defaults if age is unknown.
- Human-in-the-loop for crisis patterns: Fast off-ramps to helplines, shut down harmful threads, and surface resources for mental health.
- Establish incident response: Clear criteria for pausing features, notifying users, and shipping fixes. Practice drills like you do for outages.
Documentation that actually protects you
- PRDs with safety acceptance criteria: Define harm types, eval thresholds, and gating conditions next to your functional specs.
- Model/version bill of materials: Track models, datasets, safety layers, and third-party components per release.
- Risk assessments per feature: Record risks considered, mitigations chosen, and tradeoffs. If you can't show your thinking, it didn't happen.
- Warning and label registry: Maintain the exact copy, placement, and triggers. Update when behavior changes.
Supply chain and vendor contracts
- Indemnities and pass-through obligations: Push safety, logging, and coop-in-litigation terms to model vendors and tool providers.
- Eval and transparency clauses: Require evidence of vendor red-teaming, fine-tuning data sources, and safety patches.
- Kill switch capability: Ensure you can disable a risky model or feature without a full redeploy.
Design patterns to avoid (high liability risk)
- Emotional entanglement loops: Companion features that simulate romance, amplify dependency, or discourage real-world help.
- Authority theater: Faux certainty, fake references, or UI that overstates accuracy.
- Dark patterns around consent: Hidden data collection, pre-checked sharing, or manipulative upsells in sensitive contexts.
