Elon Musk’s xAI Commits to EU AI Safety and Security Code
Elon Musk’s AI company, xAI, announced it will sign the chapter on safety and security of the European Union’s AI code of practice. This code is part of the EU’s effort to guide companies toward compliance with its landmark artificial intelligence regulations.
The code consists of three chapters: transparency, copyright, and safety and security. While transparency and copyright guidelines apply broadly to all general-purpose AI providers, the safety and security chapter specifically targets providers of the most advanced AI models.
Voluntary Commitment with Legal Benefits
Signing the code is voluntary. However, companies that choose not to sign miss out on the legal certainty offered to those who do. The code was developed by 13 independent experts to provide clear standards for AI development and deployment within the EU.
xAI’s Position on the EU AI Act
xAI expressed support for AI safety measures within the EU AI Act and confirmed its intention to sign the safety and security chapter. However, the company also criticized parts of the AI Act, highlighting concerns that some requirements could hinder innovation and that copyright rules in the code represent an overreach.
In a post on X, xAI stated:
"While the AI Act and the Code have a portion that promotes AI safety, its other parts contain requirements that are profoundly detrimental to innovation and its copyright provisions are clearly (an) over-reach."
The company has not clarified whether it will sign the other two chapters on transparency and copyright.

- Microsoft: President Brad Smith indicated the company is likely to sign.
- Meta (Facebook): Has declined to sign, citing legal uncertainties and concerns that the code goes beyond the AI Act’s scope.
