Sullivan & Cromwell Apologizes for AI-Generated Errors in Court Filing
Sullivan & Cromwell, one of the country's oldest law firms, apologized to a federal judge after submitting a bankruptcy court motion riddled with errors created by artificial intelligence, including fabricated case citations.
The firm discovered approximately three dozen errors in the filing submitted to U.S. Bankruptcy Court in Manhattan. Many involved passages attributed to real cases that did not exist - a phenomenon known as AI hallucination. Lawyers from the opposing firm caught the mistakes.
Andrew Dietderich, a partner at Sullivan & Cromwell, wrote to Judge Martin Glenn on April 18: "We deeply regret that this has occurred." The firm provided a three-page ledger documenting the errors.
Why This Matters for Legal Professionals
The incident underscores a growing problem in law firms: AI systems generate plausible-sounding but false information, particularly when citing legal precedent. Lawyers increasingly rely on AI for research and document drafting to manage heavy caseloads, but the technology remains prone to inventing facts.
Sullivan & Cromwell represents President Trump in several appeals, including his 2024 criminal conviction. The firm's prominence makes the error particularly visible, but similar problems have surfaced across the legal profession.
The legal community is grappling with how to use AI without creating liability. Courts have begun sanctioning firms for submitting AI-generated falsehoods. No clear standards yet exist for when and how lawyers should use these tools.
For legal professionals, the lesson is direct: AI-generated content requires rigorous verification before submission. Citations, case law, and factual claims need human review - particularly when they form the foundation of court filings.
