How AI Is Forcing Trademark Strategy to Evolve

Seventy-four percent of in-house trademark practitioners now actively use artificial intelligence tools, according to a March survey by the International Trademark Association. That adoption rate is redefining how legal teams approach everything from brand creation to enforcement.

General counsel and outside counsel are facing concrete changes in examiner behavior, adversary tactics, and marketplace dynamics. Clients expect legal advice that reflects these shifts.

Creative Pipeline Altered

Marketing teams can now produce dozens of names and logos in a single session using generative tools. The speed creates risk: many AI models train on datasets that include existing brands, so output may unintentionally resemble someone else's mark. AI-generated assets also tend toward similar styles, making true distinctiveness harder to achieve.

For general counsel, this is both an operational and legal issue. If designers use AI tools without involving legal, your team loses visibility into whether output replicates existing marks. Document meaningful human creative decisions - what the team contributed, how they directed the output, not just whether AI was used. That record matters for registrability and for preserving enforcement rights later.

AI Clearance Tools Create False Confidence

Speed in AI-assisted clearance tools presents a major problem: a false sense of confidence. While these tools spot obvious visual matches, they miss nuances like phonetic similarity, marketplace context, and consumer perception. They struggle with foreign equivalents, stylized marks, and niche terminology.

Trademark law depends on consumer perception. An algorithm cannot run a true likelihood-of-confusion analysis. AI can identify potential issues, but human judgment should be the deciding factor in close calls. Its output should never be the final determination.

Enforcement Arms Race

The USPTO launched Class ACT in March, an AI tool that automatically assigns classes, design search codes, and pseudo-marks. Applicants now need to consider how an AI system - not just a human examiner - will evaluate a mark during prosecution.

Infringers who once ignored demand letters now generate professional responses quickly using AI. Opposers and petitioners use AI to draft arguments and identify prior rights more efficiently. Courts are seeing AI-generated content cited as fact, including hallucinated citations and fabricated specimens.

Because AI outputs cannot be fully explained, it is difficult to determine whether elements in a filing were intentional or a byproduct of training data. That uncertainty makes disputes more complex, costlier, and less predictable. Assume AI tools will review submissions at some stage. Double-check citations and supporting materials, even when they appear accurate.

Counterfeiting and Marketplace Abuse

AI has made it inexpensive to produce convincing knockoffs. A single infringer can generate dozens of variations in minutes. As "dupe culture" grows, products mimic a brand's look and feel without clearly infringing.

Tracking individual listings no longer works. Brand owners are pivoting to strategies that track patterns across platforms using real-time detection tools. The Model Context Protocol, a standard that allows AI systems to query external databases in real time, could eventually enable AI tools to check trademark records and marketplace listings as part of a unified workflow.

Human oversight remains critical. Someone must verify findings, assess risk, and decide which action makes sense. Brands that succeed spot trends early and act before problems escalate.

Internal Use Poses Serious Risk

Employees often use generative tools to brainstorm names, draft content, and create visual assets without considering trademark implications. A prompt entered into a public model could reveal confidential plans, which may then remain stored in AI models beyond your company's control.

This is a governance issue that belongs on legal's agenda. Companies need clear, AI-specific brand policies: which tools are allowed, what must be disclosed to legal, and who can approve AI-generated assets. Audit how your marks appear in external datasets and whether opt-out mechanisms or contractual protections are appropriate.

Without clear guardrails, everyday AI use can create ongoing issues that are difficult to reverse and may expose competitive information.

What Legal Teams Should Do Now

General counsel should prioritize updating systems, workflows, and agreements that govern how marks are created, cleared, protected, and enforced. Outside counsel need to understand how AI influences examiner decisions, adversary behavior, and marketplace dynamics so clients can adjust before a dispute arises.

Involve legal teams early enough that even a simple prompt does not create problems now or in the future. The goal is to adopt clear policy before AI-generated issues become difficult to reverse.
