Healthcare Providers Face Murky Rules on AI Translation Tools
Healthcare covered entities using AI to translate documents for patients with limited English proficiency operate in legal gray area. Federal regulations require human review of machine-translated materials in many cases, but the rules were written before generative AI existed, leaving ambiguity about what compliance actually means.
The primary federal framework is Section 1557 of the Affordable Care Act, which prohibits discrimination based on national origin. The law requires covered entities to provide qualified interpreters for patients with limited English proficiency. A qualified interpreter must demonstrate proficiency in English and another language, plus adhere to confidentiality and ethics standards.
The regulations don't ban machine translation outright. They do require human review by a qualified translator when the underlying text is critical to patient rights, benefits, or meaningful access-or when accuracy matters. In healthcare settings, most documents likely meet at least one of these criteria.
Federal Guidance Remains Inconsistent
The Department of Health and Human Services has sent mixed signals. In May 2024, the Office for Civil Rights updated its Section 1557 rule and specifically declined to require that machine translation always be checked by a human translator. The office also chose not to mandate patient notification when AI is used.
Seven months later, in December 2024, the same agency issued different guidance. In emergencies, a qualified translator may review machine-generated translations after the crisis passes, but only as a narrow exception. Otherwise, review must happen "as soon as practicable." Patients should be warned that machine-translated documents may contain errors.
States Are Setting Their Own Standards
Texas and California have begun filling the federal gap with their own rules. Texas's Responsible AI Governance Act requires disclosure when AI is used in healthcare services. California's AB 3030 requires a disclaimer when AI communications lack human review-though human review itself isn't mandated.
California's pending AB 1242 goes further. The bill would exclude AI-translated materials without human review from the legal definition of "qualified interpreter" and "qualified translator." This language reflects skepticism that current AI tools meet professional standards.
What Healthcare Organizations Should Do Now
Covered entities cannot rely on AI alone to meet language access obligations. AI may assist translation work, but it cannot replace qualified human translators where meaningful access is required.
Organizations need to track requirements in each state where they operate. Federal rules remain ambiguous and continue to shift. State rules vary widely. The safest approach: assume human review is necessary for most healthcare documents, disclose when AI is used, and document the review process.
